IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION These Terms contain a binding arbitration agreement, a class action waiver, and a mass action waiver that affect your legal rights. Except as expressly provided herein, disputes will be resolved on an individual basis through final and binding arbitration. You have the right to opt out of arbitration as described in Section 18. Please review Section 18 carefully.

This website is operated by Fyr Skin. Throughout these Terms, "we," "us," and "our" refer to Fyr Skin. By visiting our website and/or purchasing from us, you engage in our Service and agree to be bound by the following Terms of Service, including all policies referenced herein.
These Terms apply to all users of the site, including browsers, customers, vendors, and contributors of content. Please read them carefully before accessing or using our website. If you do not agree, you may not access the website or use any Services.
Any new features or tools added to the store are also subject to these Terms. We reserve the right to update these Terms at any time. Your continued use of the website following any changes constitutes your acceptance of those changes.
1. Acceptance of Terms
By accessing our website, creating an account, enrolling in a subscription, or completing a purchase, you:
- Represent that you are at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement
- Agree to be bound by these Terms in their entirety
- Acknowledge that where presented, your affirmative action (such as checking a box or clicking a clearly labelled button) constitutes legally binding electronic consent
If you do not agree to these Terms, you must not access or use the website.
2. Online Store Terms
You may not use our products for any illegal or unauthorised purpose, nor may you violate any laws in your jurisdiction in connection with your use of the Service. A breach or violation of any of these Terms will result in immediate termination of your access to our Services.
3. General Conditions
We reserve the right to refuse Service to anyone for any reason at any time. Credit card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission from us.
4. Accuracy of Information
We are not responsible if information made available on this site is not accurate, complete, or current. Material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. We reserve the right to modify the contents of this site at any time without obligation to update any information. Any reliance on site content is at your own risk.

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service at any time without notice and shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
6. Products and Services
Certain products may be available exclusively online and may have limited quantities. We have made every effort to display product colours and images accurately, but we cannot guarantee that your device's display will be accurate. All product descriptions and pricing are subject to change at any time at our sole discretion. We reserve the right to limit sales of our products to any person or geographic region on a case-by-case basis.

Statements made regarding Fyr Skin products have not been evaluated by the United States Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. All information provided on this website is for informational and educational purposes only and does not constitute medical advice. You should consult a qualified healthcare professional before beginning any new skincare programme, particularly if you are pregnant, nursing, taking medication, or have a known skin condition. Individual results may vary.
8. Subscription Programme
Fyr Skin offers a subscription programme that provides automatic recurring shipments of products at the frequency selected during checkout. By enrolling, you agree to the following:
8.1 Automatic Renewal
Unless you cancel in accordance with these Terms, your subscription will automatically renew at the then-current rate at the same billing interval selected at checkout. You will not receive an additional reminder before each renewal unless required by applicable law. If pricing changes, we will provide advance notice as required by law.
8.2 Recurring Billing Consent
At the time of enrolment, recurring billing terms — including the fact that charges will recur automatically, the billing frequency, the amount to be charged, and the cancellation policy — will be presented clearly before your purchase is completed. Your affirmative action at checkout constitutes express consent to recurring charges.
8.3 How to Cancel
You may cancel your subscription at any time. To avoid the next scheduled charge, cancellation must be completed at least forty-eight (48) hours before your next billing date. You may cancel by:
- Logging into your account and following the cancellation instructions
- Emailing support@fyrskin.com
We will not require you to call a live representative to cancel. After cancellation, no future charges will be made and no additional shipments will be sent after the current billing cycle.
8.4 Minimum Commitment
By enrolling in a subscription, you agree to a minimum commitment of two (2) consecutive billing cycles. The first and second billing cycles are non-refundable once processed or shipped.
8.5 Early Cancellation Fee
Cancelling before completion of the minimum two-cycle commitment may result in an exit fee representing the difference between the subscription price and the standard retail price for products already supplied.
8.6 Failed Payments
If a recurring charge fails, we reserve the right to retry the charge, contact you for updated payment information, and suspend shipments until payment is received. Your continued enrolment constitutes reaffirmation of your authorisation to charge your payment method. We may use an automatic account updater service to refresh stored payment details if your card issuer provides updated information.
8.7 Subscription Refunds
Subscription orders are not eligible for the 120-Day Satisfaction Guarantee. Refunds on subscription orders may be considered for unopened and unused items only. Return shipping is the responsibility of the customer. Shipping and handling fees are non-refundable. To request a refund on a subscription order, email support@fyrskin.com with your order details.
9. Order Cancellations
One-time orders may only be cancelled before tracking information has been issued. Once tracking has been provided, the order is considered in fulfilment or transit and cannot be cancelled. All cancellation requests must be submitted in writing to support@fyrskin.com. A $2.00 administrative fee may apply. Cancellation requests submitted via social media, live chat, or chargeback disputes will not be treated as valid cancellation notices.
10. Billing and Account Information
We reserve the right to refuse any order at our sole discretion, including orders that appear to be placed by resellers or distributors, or that involve suspected fraud or pricing errors. You agree to provide current, complete, and accurate purchase and account information for all orders and to promptly update this information as needed.
By providing a payment method, you represent that you are authorised to use it and that all payment information is accurate. You authorise Fyr Skin to charge your payment method for products purchased, subscription renewals, shipping charges, applicable taxes, and any other disclosed fees.
11. Coupon and Discount Code Policy
Coupons and discount codes must be applied at checkout. We are unable to apply codes or issue refunds for missed discounts after an order is placed. Each code may include conditions such as expiry dates, eligible products, or minimum spend requirements. Customers are responsible for reviewing promotion terms before purchasing. Promotional offers such as bundle deals are only valid when the correct items are added to the cart at checkout and cannot be applied retroactively. Misuse of codes — including sharing single-use codes or creating multiple accounts to redeem one-time offers — may result in order cancellation or account suspension.
12. 120-Day Satisfaction Guarantee
Fyr Skin offers a 120-Day Satisfaction Guarantee exclusively for customers who do not experience results after a minimum of 120 consecutive days of daily and consistent use in accordance with product instructions. This guarantee applies to first-time purchases of a specific product only and is limited to one claim per product type per customer.
To be eligible, customers must demonstrate compliant usage. Where eligibility is confirmed, Fyr Skin will refund the purchase price less a 15% processing and handling fee, issued to the original payment method. Shipping fees are non-refundable. If you choose to exchange your product, the guarantee no longer applies to that product.
This guarantee applies exclusively to lack of results and does not cover personal preference, scent, texture, packaging, appearance, or inconsistent use. Sale items and gift cards are excluded. All claims must be submitted within 127 days of the original delivery date to support@fyrskin.com.
13. Chargeback Policy
Before filing a dispute or chargeback with your bank or card issuer, you agree to first contact us at support@fyrskin.com so we can resolve the matter directly. Chargebacks raised without prior contact, or outside the scope of a valid claim under our policies, may be treated as invalid where the transaction was legitimate and authorised. Once a chargeback is opened, refund processing is paused until the dispute is formally resolved through your card provider. Filing a chargeback for an active subscription renewal without following applicable cancellation terms constitutes a breach of your subscription agreement.
14. Shipping and Customs
Products are shipped via third-party carriers. Title and risk of loss transfer to you upon delivery to the carrier. Carrier delivery confirmation constitutes conclusive proof of delivery for the address you provided, even without a signature, and serves as sufficient evidence of delivery for the purposes of resolving disputes including chargebacks or non-delivery claims.
We are not responsible for delays caused by carriers, weather, customs, or incorrect shipping information provided by you. International customers are responsible for all customs duties, import taxes, and fees assessed by their local customs authority. These are not collected by Fyr Skin and cannot be refunded.
It is your responsibility to provide a correct and complete shipping address. If an order is returned due to an incorrect address or refused customs payment, a refund will be issued minus the 15% processing and handling fee once the return is confirmed.
15. Third-Party Links and Tools
Our website may include links to third-party websites or access to third-party tools. We are not responsible for the content, accuracy, or practices of any third-party sites or tools. Any use of third-party tools offered through our site is entirely at your own risk. Complaints regarding third-party products or services should be directed to the relevant third party.
16. User Content
By submitting reviews, testimonials, comments, or other content to our website, you grant Fyr Skin a perpetual, worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, modify, distribute, and display such content for business and marketing purposes. You represent that you own or control all rights in the content you submit, that it does not violate any third-party rights, and that it is truthful and not misleading. We reserve the right to remove or refuse to post any user content at our sole discretion.
17. Prohibited Uses
You are prohibited from using the site or its content for any unlawful purpose; to violate any applicable laws or regulations; to infringe upon our intellectual property rights or those of others; to harass, abuse, defame, or discriminate against any person; to submit false or misleading information; to upload malicious code or viruses; to collect personal information of others without consent; or to interfere with the security or operation of the website. We reserve the right to terminate your access for any violation of these prohibited uses.
18. Dispute Resolution and Binding Arbitration
Please read this section carefully. It affects your legal rights.
18.1 Agreement to Arbitrate
Except as expressly provided below, you and Fyr Skin agree to resolve all disputes exclusively through final and binding individual arbitration. This applies to any dispute, claim, or controversy arising out of or relating to these Terms, the website, any product, any subscription or automatic renewal, or any marketing or advertising practices (collectively, a "Dispute"). The term "Dispute" shall be interpreted broadly.
18.2 Pre-Arbitration Notice
Before initiating arbitration, the initiating party must send a written Notice of Dispute including full name, mailing address, email address associated with the account, a description of the claim, and the specific relief sought. The parties shall engage in good-faith efforts to resolve the Dispute for thirty (30) days before filing for arbitration.
18.3 Arbitration Procedure
Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules before a single neutral arbitrator. The arbitrator may award all remedies available under applicable law on an individual basis but may not award relief on a class, representative, or consolidated basis. The Federal Arbitration Act governs the interpretation and enforcement of this agreement.
18.4 Cost Allocation
The Company will bear arbitration fees in excess of the amount you would be required to pay to file a comparable action in court, to the extent required by AAA Consumer Arbitration Rules. Each party shall bear its own attorneys' fees unless otherwise provided by law.
18.5 Small Claims Exception
Either party may bring an individual action in small claims court in lieu of arbitration.
18.6 Equitable Relief
Fyr Skin may seek temporary or permanent injunctive relief in state or federal courts for claims involving intellectual property, confidential information, fraud, or misuse of the website that threatens irreparable harm.
18.7 Opt-Out Right
You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by sending a written notice via certified mail to Fyr Skin, including your name, address, email, and a clear statement of your intent to opt out.
19. Class Action Waiver
You and Fyr Skin agree that all disputes shall be brought only in an individual capacity. You waive any right to participate in a class action, serve as a class representative, or consolidate claims with those of others. The arbitrator has no authority to conduct class proceedings.
20. Mass Action Waiver
No dispute shall be brought as a mass action, defined as twenty-five (25) or more similar arbitration demands filed within one hundred eighty (180) days coordinated by the same or affiliated counsel. Such claims shall be grouped in batches of no more than 200 claimants, with only one batch proceeding at a time and a separate arbitrator appointed per batch.
21. Jury Trial Waiver
If any dispute proceeds in court, you and Fyr Skin waive the right to a jury trial.
22. Limitation of Liability
To the maximum extent permitted by law, Fyr Skin and its officers, directors, employees, affiliates, agents, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to lost profits, lost data, loss of goodwill, or business interruption, arising out of or relating to these Terms, your use of the website, any product purchase, or any subscription service, regardless of the theory of liability.
Fyr Skin's total liability for any claim shall not exceed the greater of (a) the total amount you paid to Fyr Skin in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars (US $100.00). This shall constitute your sole and exclusive remedy.
23. Indemnification
You agree to defend, indemnify, and hold harmless Fyr Skin and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the website or products, your violation of any law, or your violation of any third-party rights.
24. Limitation on Time to File Claims
To the fullest extent permitted by law, any claim arising out of or relating to these Terms, the website, any product, or any subscription service must be commenced within one (1) year after the claim accrues. Claims not brought within this period are permanently barred.
25. Force Majeure
Fyr Skin shall not be liable for any delay or failure to perform any obligation under these Terms resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, labour disputes, supply chain disruptions, governmental actions, war, terrorism, internet failures, payment processor outages, or carrier delays.
26. Privacy and Communications
Your use of our website is governed by our Privacy Policy. By using the website, creating an account, or making a purchase, you consent to receive electronic communications from us including order confirmations, shipping notifications, subscription reminders, and customer service communications. You may opt out of marketing emails at any time using the unsubscribe link. Electronic communications satisfy any legal requirement that such communications be in writing.
27. Intellectual Property
All website content including text, images, graphics, trademarks, logos, software, and design elements are owned by or licensed to Fyr Skin. You may not reproduce, distribute, modify, or exploit any website content without our prior written consent. No rights are granted except as expressly provided in these Terms.
28. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law and the unenforceable portion shall be deemed severed. All remaining provisions shall remain in full force and effect.
29. Entire Agreement
These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and Fyr Skin and supersede all prior agreements, communications, or proposals. No waiver of any provision shall be deemed a continuing waiver. Fyr Skin may assign or transfer these Terms in connection with a merger, acquisition, or sale of assets. These Terms shall be binding upon and inure to the benefit of the parties and their permitted successors and assigns.
30. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state of Delaware, United States, without regard to conflict-of-law principles. For matters not subject to arbitration, you consent to the exclusive jurisdiction of the applicable courts.
31. Changes to Terms
We reserve the right to update or replace any part of these Terms at any time by posting changes to our website. It is your responsibility to check this page periodically. Continued use of the website following the posting of changes constitutes your acceptance of those changes.
